Welcome to Surfast. By downloading and using our app, you agree to these terms. If you don't agree, please don't use the app.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Surfast mobile application and website. By accessing or using Surfast, you accept and agree to be bound by all terms herein.

2. Description of Service

Surfast is a mobile application designed to help you track surf sessions, receive wave forecasts, and improve your surfing skills. The app includes features for GPS tracking, session analytics, AI coaching, and gamification.

3. User Accounts

You can sign in using Apple ID or Google account. You are responsible for:

Maintaining the confidentiality of your account
All activities under your account
Notifying us of unauthorized access

4. Subscriptions & Payments

Free Tier: Limited features, free forever

Surfast Premium (Monthly): Auto-renewable subscription, 1 month, $4.99/month

Surfast Premium (Annual): Auto-renewable subscription, 1 year, $39.99/year

Auto-renews on the same date each period
Cancel anytime in your device settings
Refunds handled by Apple/Google only

Billing & Refunds:

Billed through Apple App Store or Google Play
Refund requests: File with Apple/Google, not us
We cannot override platform refund policies

5. Acceptable Use

You agree NOT to use Surfast to:

Violate any laws or regulations
Harass, abuse, or threaten other users
Share another person's data without consent
Reverse-engineer, hack, or exploit the app
Scrape or automate data collection

6. Safety & Disclaimers

⚠️ OCEAN SAFETY: Surfing is inherently dangerous. Surfast cannot predict rip currents, sudden weather changes, or local hazards. Always check local conditions, surf with a buddy, and follow lifeguard warnings.

Forecast Accuracy: Our wave forecasts are estimates based on Open-Meteo and NOAA data. Actual conditions may differ significantly due to local bathymetry, reefs, and weather.

GPS Tracking: GPS accuracy varies by location, terrain, and signal strength. Session distances are approximations.

7. Intellectual Property

Surfast logo, design, and content are owned by Surfast. You may not reproduce, distribute, or modify them without permission. You own your session data.

8. User Content

Your session data and notes are your property. By using Surfast, you grant us a non-exclusive license to store, process, and display your data for app functionality.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURFAST IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE ARE NOT LIABLE FOR:

Injuries or death resulting from surfing
Data loss, inaccurate forecasts, or GPS errors
Third-party service failures (Firebase, Open-Meteo, NOAA)
Indirect, incidental, or consequential damages

YOUR SOLE REMEDY IS TO STOP USING THE APP.

10. Indemnification

You agree to indemnify and hold harmless Surfast from any claims, damages, or costs arising from your use of the app or violation of these terms.

11. Termination

We may suspend or terminate your account for violating these terms or engaging in harmful conduct. You can delete your account anytime via Settings → Account → Delete Account.

12. Changes to Terms

We may update these terms. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of California, without regard to conflict of laws.
